Ecommerce Terms of Trade

These Terms of Trade (“Terms”) govern the sale and purchase of products (“Products”) by eartH2Ocean Limited, T/A eartH2Ocean adventures (“Seller”) to you, the buyer (“Buyer”). By placing an order through eartH2ocean adventures, you agree to be bound by these Terms.

Shipping

  • Shipping is available to New Zealand addresses only.
  • Shipping fees will be calculated at checkout and will depend on the weight and size of the Products and the Buyer’s location.
  • The Seller will endeavor to dispatch the Products within 1 business days from the date of payment confirmation.
  • The Seller will provide a tracking number and delivery estimate once the Products have been dispatched.
  • The Seller is not responsible for any delays, losses or damage caused by the courier or postal service.

Returns

  • If the Products are faulty, damaged or not as described, the Buyer must contact the Seller within 7 days of receiving the Products to arrange a return.
  • The Buyer must return the Products in their original condition and packaging, and at their own cost, unless otherwise agreed by the Seller.
  • The Seller will inspect the returned Products and, if satisfied that they are faulty, damaged or not as described, will offer a replacement, exchange or refund.
  • The Seller reserves the right to refuse a return if the Products have been misused, modified, or damaged by the Buyer.

Warranties

  • The Seller warrants that the Products will be of acceptable quality and fit for their intended purpose.
  • The Seller’s liability under this warranty is limited to the replacement or repair of the Products, or a refund of the purchase price, at the Seller’s discretion.
  • This warranty does not cover normal wear and tear, misuse, or damage caused by the Buyer or a third party.

General

  • Prices and availability of Products are subject to change without notice.
  • The Seller reserves the right to cancel or refuse any order at any time.
  • These Terms may be updated by the Seller from time to time, and the latest version will be available on https://earth2oceanadventures.com/.
  • These Terms are governed by the laws of New Zealand and any disputes will be subject to the jurisdiction of the New Zealand courts.
